This policy explains how cancellations, returns, refunds and rescheduling are handled for purchases from Massbrook Driving School, including physical goods, training services and Massbrook Route Navigator digital access.
This policy should be read together with our Terms & Conditions. Nothing in this policy limits any statutory rights or remedies available to you under applicable Irish or EU consumer law.
Your rights depend on what you purchase and the circumstances of the transaction.
Different rules can apply to physical goods, services and digital products or services. This policy explains our normal commercial arrangements but does not replace rights provided by law.
Where you have a statutory right to cancel, terminate a contract, obtain a refund or receive another remedy, that right is not removed by this policy.
Consumers purchasing most standard physical goods online normally have a 14-day cancellation period beginning when the goods are received.
You must tell us within the applicable cancellation period if you wish to cancel. Where a valid cancellation right applies, you then have the additional period provided by law to return the goods.
Please contact us at hello@massbrookdrivingschool.ie before returning an item so that we can provide the appropriate return instructions.
Unless the goods are faulty or we agree otherwise, the customer is normally responsible for the direct cost of returning goods following a change-of-mind cancellation.
You are responsible for any reduction in the value of returned goods caused by handling beyond what is reasonably necessary to establish their nature, characteristics and functioning.
Some physical products sold by Massbrook Driving School may be decorated, printed or otherwise finished by us before dispatch.
A standard product does not automatically become a personalised product simply because Massbrook Driving School prints or decorates it as part of our normal product specification.
Where a product is genuinely made to a customer’s individual specification or clearly personalised, different statutory cancellation rules may apply. Any such restriction will be clearly stated before you place the order.
Personalisation does not remove your rights where goods are faulty, misdescribed or otherwise do not conform to the contract.
If goods are faulty, damaged, not as described or otherwise do not conform to the contract, please contact us as soon as reasonably possible.
Depending on the circumstances and your statutory rights, an appropriate remedy may include repair, replacement, price reduction, termination of the contract or refund.
Where goods are being returned because they are faulty or non-conforming, we will deal with reasonable return arrangements in accordance with our legal obligations.
This section applies to driving lessons, motorcycle training, Initial Basic Training (IBT), test preparation and other training services provided by Massbrook Driving School.
Where a particular course or service has different cancellation conditions, those conditions will be clearly disclosed before booking.
Unless different conditions were disclosed before booking, please contact us at least 48 hours before the scheduled start time if you wish to cancel or reschedule.
Where at least 48 hours’ notice is provided, amounts paid for the affected booking may normally be refunded or transferred to another suitable booking, subject to any applicable statutory rights and course-specific conditions.
Where less than 48 hours’ notice is provided, Massbrook Driving School may retain a reasonable amount, up to the amount paid for the affected booking, where the reserved training time cannot reasonably be filled by another customer.
We do not apply this provision simply as a penalty. The circumstances of the cancellation may be taken into account.
We recognise that genuine emergencies and exceptional circumstances occur. Please contact us as soon as possible.
We may waive or reduce a late cancellation charge where we consider it reasonable and fair to do so.
If you do not attend a confirmed booking and have not given the required notice, the booking may be treated as used and up to the full booking cost may be retained.
If you arrive late, your session may still need to finish at the originally scheduled time.
If you arrive too late for the training to be delivered safely, lawfully or meaningfully, the booking may be treated as a late cancellation.
Some courses require specific permits, licences, protective equipment, vehicles, documentation or other prerequisites.
Where a requirement was clearly disclosed before booking and training cannot proceed because that requirement has not been met, the booking may be treated as a late cancellation.
We may need to cancel or postpone training because of instructor illness, unsafe weather or road conditions, vehicle problems, venue issues or other circumstances that make the planned training unsafe or impractical.
Where we cancel or postpone a session, we will normally offer a suitable replacement date.
If we cannot provide the affected service and a suitable alternative cannot be agreed, amounts paid for the part of the service we cannot provide will be refunded as required by law.
Route Navigator is purchased as digital access for the route and access period selected when ordering.
Route access begins once an eligible successfully paid order has been processed. The access period therefore starts from the purchase/access-grant date rather than the first day you open or use Route Navigator.
Irish consumer law provides cancellation rights for many online contracts, including digital content and digital services. Different rules apply once digital supply has begun and depending on whether the supply is digital content or a digital service.
Where the law requires your prior express consent or acknowledgement before immediate digital supply affects a statutory cancellation right, we will obtain that consent or acknowledgement as part of the purchase process.
We will not treat the simple fact that Route Navigator access has been made available as removing a statutory cancellation right unless the applicable legal requirements for doing so have been satisfied.
This section does not affect your statutory remedies where Route Navigator is not supplied, does not work as described, or otherwise fails to conform to the contract.
If Route Navigator is not working as expected, please contact us before assuming that your access has been lost.
Many access problems can be resolved by reconnecting, refreshing access, correcting an installation record or providing technical support.
Where digital content or a digital service does not conform to the contract, statutory remedies may include bringing it into conformity, a proportionate price reduction or termination/refund where the legal conditions for those remedies are met.
Where no statutory cancellation right applies, we are not required to provide a refund simply because you change your mind after purchasing and receiving valid Route Navigator access.
However, we will consider genuine mistakes and exceptional circumstances fairly. Please contact us as soon as possible if there is a problem with your purchase.
If you purchase another access period for the same Route Navigator route, the additional purchase will normally extend your existing access period for that route.
If the additional purchase was genuinely accidental, contact us promptly with your order details.
We will review the circumstances and, where appropriate, correct the access or refund the accidental duplicate purchase rather than requiring you to keep unwanted additional access.
If you accidentally purchase the wrong Route Navigator route, please contact us as soon as possible.
Where reasonably possible, we will normally resolve the mistake by replacing or transferring the purchased access to the route you intended to buy.
A refund will not normally be necessary where the issue can be fully resolved by providing the correct route access.
If you believe you selected the wrong access option or made another genuine ordering mistake, contact us with your order details and we will review the purchase.
Our aim is to resolve genuine mistakes reasonably rather than rely on technicalities where a straightforward correction is available.
Nothing in this section affects any statutory cancellation or consumer right that applies to the purchase.
Where a refund is due for an order purchased using a coupon, promotional code or other discount, the refund will normally be based on the amount actually paid for the affected product or service.
Discounts do not normally alter the duration or characteristics of Route Navigator access unless the promotion expressly states otherwise.
Where a refund is due, it will normally be returned using the same payment method used for the original transaction unless another lawful arrangement is agreed.
Processing times after we issue a refund may depend on the payment provider or financial institution involved.
Where a Route Navigator refund affects associated digital access, we may also amend, revoke or correct the corresponding access entitlement as appropriate to the refunded transaction.
A refund affecting one purchase will not normally remove unrelated Route Navigator access that remains valid.
If a payment is reversed, refunded or successfully charged back, access or services provided solely under that payment may also be withdrawn or adjusted as appropriate.
Please contact us first where possible if there is a problem with an order. Many issues can be resolved more quickly without a payment dispute.
This does not restrict any legal right you have to dispute an unauthorised or incorrect payment with your payment provider.
